Terms and Conditions {PLEASE READ ME}

Exam Success® prides itself on being an honest and transparent company. Your success is the reason we are in business and have been in business for nearly 20 years. Please help us to continue to offer great customer service to you by reading these terms and conditions carefully before purchasing, accessing, using or obtaining any Exam Success materials, information products or services.

These terms and conditions have been put in place to insure that every customer is treated fairly and professionally and Exam Success can run a reasonable business. By accessing the Exam Success website, mobile or tablet application, or any other online product, service or preparatory material, resource, feature or other Exam Success platform (collectively “Our Website”) you agree to be bound by these terms and conditions (“Terms”) and our Privacy Policy. If you do not accept all of these Terms then you may not use Our Website. In these Terms “we”, “our”, "us" or “Exam Success” refers to “Exam Success” and “you” or “your" refers to you as the user of Our Website.

1. Payments

a. OUR PREFERRED METHOD OF PAYMENT: We accept VISA, MASTERCARD or AMEX. Payments are made on the Exam Success website through PayPal (no PayPal account is required). Sometimes for security reasons PayPal declines valid credit cards. PayPal's suggestion is to try the transaction later or to link a bank account directly to PayPal. OTHER PAYMENT OPTIONS: Direct payment to Exam Success can be arranged. Please call us at 416.843.4357 or 1.800.558.9796.

b. RECURRING BILLING: The Installment Payment Plan (IPP) option is available on select programs. It is a contract between you and Exam Success that obliges you to pay your lump sum tuition due upon enrolment plus a $100 set-up fee, in automatically billed monthly installments. Our programs are NOT drop-in or pay as you go. The first Installment Payment is due at at checkout (official enrolment) and the remaining balance due is to be paid in installments regularly scheduled over the course of the program. You understand Exam Success is advancing value to you in the form of educational services and that your right to enrol is expressly conditioned upon your agreement to pay these obligations on time in full, without an equivalent value of delivered of service. In other words, if you choose to accept less services, you are still required to make your installment payments because the benefits have been available to you out of goodwill from the initial installment payment made. As long as you make all your scheduled payments as due, you can reduce or eliminate your payment of penalties or interest services and reinstatement /new agreement fees and being prohibited from attending classes / accessing resources. If you are in danger of defaulting on your payment agreement for any reason, contact us immediately. We will generally do not take enforced collection actions.

c. All prices are in Canadian dollars, 13% HST will automatically be added.

d. NSF cheques and late payments are subject to a $40 admin fee. There may be a reinstatement fee if your Installment Payment Plan agreement goes into default or is suspended. Penalties and interest continue to accrue until your balance is paid in full. A student who fails to make payment of tuition and fees, including any incidental fees, by the due date may be prohibited from registering/ attending classes /accessing resources, services and materials…until full payment is made. If you are in danger of defaulting on your payment agreement for any reason, contact us immediately. We reserve the right to report your liability with us to a credit agency/collections agency. We will generally not take enforced collection actions.

e. Receipts are automatically generated on-line when you pay using Paypal. If this is receipt is not sufficient for your income tax or corporate reimbursement purposes, ask for a copy of your registration form by contacting Exam Success at info@examsuccess.ca. If there are specific program and/or curriculum details you require the receipt to include, please advise us. Unless otherwise requested, your receipt will be sent to you by email within TWO weeks provided that your final payment has been made and it is no earlier than THREE weeks after the program start date.

f. We reserve the right to correct any incorrect charges that might have occurred to orders.

2. CFA Groups Savings Policy

a. Weekly Classes Study Program and Complete Study Program  - Unless otherwise noted a Group (3 or more candidates) who enrol in a Weekly Classes Study Program or a Complete Study Program for the same exam season (any level) and pay in full with a credit card at time of enrolment get a 5% cash back tuition rebate.

b. Group Savings applies only when a) 1 returning Exam Success CFA student + 2 or more new students enrol together or b) 3 or more new students enrol together. A new student is someone who has never attended an Exam Success CFA Program or purchased Exam Success CFA material previously, in any year. Groups formed at an Exam Success hosted event are not eligible for the rebate. The 5% rebate is calculated based on the tuition price (pre-tax) in effect on the date of the student's' enrolment and will be issued 30 - 45 days after the program start date and only if all those in the group have remained in the program past the cancellation date. Group savings are not combinable with any other offers except the Early Bird. Only Groups who have submitted a Group Booking Request Form by email to Exam Success prior to enroling will eligible for the savings. Group enrolments are subject to availability and unless otherwise noted, must be made within 48 hours of each other.

3. Cancellations and Refunds

a. Online Products, Services, Downloads:

All purchases are FINAL and NON-REFUNDABLE whether or not they were purchased on their own or as part of a package or a promotion and regardless of utilization.


b. Live In-class Seminars, Programs, Workshops, Reviews:

If you cancel/ withdraw:

PARTIAL REFUND: Cancellations made at least 31 calendar days prior to the start of the program are eligible for a refund, minus a $199 admin fee minus the regular retail price of any online product/ package included in the original program/package, regardless of utilization. Our programs are NOT drop-in or pay as you go. Enrolment tuition and fees are non-transferable.

NO REFUND: Cancellations made later than than 31 days before the start of the program, regardless of the reason, are not eligible for any refund whatsoever, even in the event of a medical condition or other extreme circumstance. We reserve and pay for classroom space, equipment, furniture, support services, printing on paid enrolments. All classrooms have limited seating. When a candidate wishes to cancel or withdraw after 31 days prior to program start date, his/her space in the course cannot be filled by another candidate. Our programs are NOT drop-in or pay as you go. Enrolment tuition and fees are non-transferable. Absence from class or failure to attend, for any reason, does not signify a cancellation and does not reduce or relieve you of your financial responsibility and you remain liable for full tuition and fee charges.

NOTE: All notifications of cancellation must be received in writing by email to info@examsuccess.ca.

If Exam Success Cancels:

a. Classes canceled due to inclement weather is a rare occurrence however, if this does occur, fees remain constant. No refunds or, partial payments, or adjustments should be expected.

b. Instructor absences or substitution: This is a rare occurrence but in the event that an instructor is absent or there is a substitute instructor, fees remain constant. No refunds, partial payments, or adjustments should be expected.

c. Classes canceled due to low enrolment: Every effort will be made to run our in-class programs without changing dates and instructors. Programs that do not reach a minimum enrolment number by the scheduled program/class start date may be be cancelled and/or rescheduled to a later date at the sole discretion of Exam Success. Exam Success reserves the right to cancel and reschedule programs, classes, change fees, days, hours and instructors without prior notice. If Exam Success cancels or reschedules a program you are enroled in due to low enrolment, you have the option of taking a full refund less the retail cost of any online product/package included in the package or transferring your program fee to another Exam Success resource or program. Exam Success’ liability is limited only to the reimbursement of the tuition fee, less applicable charges. Exam Success is not responsible for student's travel/accommodation or other expenses.

NOTE: Cancellations are only in effect once Exam Success has provided express confirmation by way of email. It may take up to 5 business days for an email/reply/confirmation so please plan accordingly.

4. CFA Course Upgrades, Downgrades, Deferrals

a. Students can upgrade to a course (in the same exam season) that is more expensive or has the same price and is offered in the same exam season and just pay the applicable price difference between the two, provided that Exam Success has received the student's written request within 30 days of the original purchase and no more than 14 days from the start of the course to which the student would like to upgrade.

b. Students can downgrade to a course that has a lower price and is offered in the same exam season if written request is received at least 31 days prior to the first class of the program from which the student wishes to transfer. The student will receive a refund of the difference less the regular retail price of any online product included in the original package (regardless of utilization) and will be required to pay a $79 processing fee.

c. Deferrals to the same Exam Success seminar/program/course the next available exam season (not beyond) are considered on a case-by-case basis and only for extreme circumstances such as: (a) debilitating or life threatening and physician documented medical or psychological conditions (student or immediate family member), or (b) unanticipated and documented personal emergencies beyond the control of the candidate. This does not guarantee a deferral to any student for any condition instead provides Exam Success with the discretion to determine which deferral requests it approves and denies. For any request to be considered, an email deferral request accompanied by sufficient rationale and original supporting documentation must be received by Exam Success at info@examsuccess.ca at least 10 days prior to the first scheduled class in the course from which the student would like to defer. Students awarded a deferral are responsible for a non-refundable re-enrolment processing fee (due at the time of deferral) equivalent to 25% of the listed regular retail price for the same course/program the next available exam season. The minimum re-enrolment processing fee is $149.

NOTE: All notifications of Course Upgrades, Downgrades, Deferrals must be received in writing by email to info@examsuccess.ca. All upgrades and downgrades and deferrals are subject to availability.

5. Online Access Expiry

a.CFA Unlimited login access to online products / resources is available from the time after your purchase/ enrolment when your account is activated, until its expiry on the last day of the exam month. Exam Success releases a new version of products every year as curricula change. Shared use is strictly prohibited. Use of Online Access via www.examsuccess.ca. Exam Success does not warrant that this Online Access will be uninterrupted or error-free. Online Access to www.examsuccess.ca is provided on an "as is, as available" basis.

6. Success Guarantee: CFA Course Re-Activation / Retakes

Our aim is for our students to pass and we stand behind our study solutions!   In the event you do not pass or write the exam for which you were scheduled, we invite you back to receive these privileges:

a. FREE Online Resource Access Reactivation as many times as you want within 1 year following your course expiry (last day in the exam month). You must contact Exam Success by email at info@examsuccess.ca to have your online access /enrolment reactivated.


b. DISCOUNTED Class Course Re-enrolment as many times as you want within 1 year following your course expiry (last day in the exam month) at a discount of up to 50% off the regular price at the time of re-enrolment. You must contact Exam Success by email at info@examsuccess.ca with your request. Discounted re-enrolment is subject to availability and fees are due at the time of re-enrolment.


c. While we do everything in our power to make the exam-prep process painless, passing the exam is ultimately your responsibility and Exam Success makes no guarantee, warranty or representation whatsoever regarding relating to the passing of the actual exams.

7. Privacy Policy

a. If you choose to open an account with us, request support, or in any other way take steps that require the submission of Personal Information or Non-Personal Information, we may collect information such as your name, email address, phone number, and/or physical address to be used by us or our affiliates or by companies pre-screened by us to provide you with the services or functionality you have requested; respond to any inquiries you have made; contact you to promote our Services or alert you to special offers or features. We do not sell or rent your personal information to any company, organization or individual. We will retain your information throughout and beyond the exam season to help us to communicate with you and to contact you when we feel that we have new information or programs that may be of interest to you. You may opt out of receiving such materials at any time by contacting us at info@examsuccess.ca, provided however that we reserve the right to retain an archive of such Personal Information for a commercially reasonable time to ensure that its deletion does not affect the integrity of our data; and we further reserve the right to retain an anonymous version of such information.

8. Right to Transfer/Single User License

a. Your subscription to any Online Access, including PDFs is a limited license to use the content only between the time of access is granted and the exam date of the product purchase. The subscription is licensed for the personal, non-commercial use and benefit of the registered customer only, and grants user rights to only one individual. No other individual or group may view or utilize the subscription in anyway whatsoever without the express written consent of Exam Success. Usernames/user ids and passwords are not to be shared with anyone, even if that person has his or her own subscription to Online Access. Such sharing or suspected sharing of usernames/user ids and passwords is a violation of this Agreement and will result in immediate suspension of your privileges to any Online Access at info@examsuccess.ca without refund or credit. Exam Success monitors its website, including the use of Online Access, for visitors and enforces its one subscriber-one user policy diligently. Creating, purchasing, and/or using photocopied (i.e., pirated, illicit copies) Exam Success study notes and other preparatory materials violates the law and may violate Code of Ethics and Standards of Professional Conduct as set forth by the respective accrediting agencies.

9. Recording/Duplicating

a. You may not copy or reproduce, distribute, share through any information network, transfer, sell, lease or rent any part of the course or materials to any other person or group, in whole or in part.

10. Consent release for use of images for promotional purposes

a. You agree that portions of the class may be photographed or video taped for marketing purposes and that Exam Success may use personal data, images and video footage of you in a range of public promotional purposes (both hard copy and electronic) including publications, promotional material, websites, social media and advertisements.

11. Services

a. Exam Success provides services that allow users to connect with tutors and instructors who provide live, one-to-one tutoring and learning services and classroom instruction in person or online. We generally do not control, and we make no representations or warranties regarding the reliability of, any verification service or any information provided by such verification service we use to confirm the validity of our tutors’ lack of criminal history and claimed educational credentials.

12. Your Acceptance of These Terms

a. Exam Success may modify the Terms at any time and such modifications shall be effective immediately upon posting of the modified Agreement and are subject to change without notice. You agree to review the Terms periodically to be aware of such modifications and your continued access or use of Online Access and other preparatory materials and services shall be deemed your conclusive acceptance of the modified Agreement. If you object to these Terms or any subsequent modifications to these Terms or become dissatisfied with Our Website in any way, your only recourse is to immediately terminate use of Our Website.

b. Failure to abide by these Terms will result in immediate termination of your course and/or access to materials and services without refund or option to transfer/reschedule.
