Exam Success™ prides itself on being an honest and transparent company. Your success is the reason we have been in business for more than 20 years.

Please help us to continue to offer great customer service to you by reading these terms of service carefully before purchasing, accessing, using or obtaining any Exam Success materials, information products or services.

These policies have been put in place to ensure that every customer is treated fairly and professionally and Exam Success can run a reasonable business. By accessing the Exam Success website, mobile or tablet application, or any other online product, service or preparatory material, resource, feature or other Exam Success platform (collectively “Our Website”) you agree to be bound by these Terms Of Use (“Terms”) and our Privacy Policy. If you do not accept all of these Terms then you may not use Our Website. In these Terms “we”, “our”, "us" or “Exam Success” refers to “Exam Success” and “you” or “your" refers to you as the user of Our Website. Exam Success administration team members are readily available to answer any questions or concerns.

1. Payments

a. Preferred Method of Payment: We accept VISA, MASTERCARD or AMEX. Payments are made on the Exam Success website through Stripe. Sometimes for security reasons Stripe declines valid credit cards. Stripe's suggestion is to try the transaction later or to link a bank account directly to Stripe. OTHER PAYMENT OPTIONS: Direct payment to Exam Success can be arranged. Please contact us in writing.

b. In-Person CFA Program Prep Payment Plan (RECURRING BILLING): The Payment Plan is an installment plan option that is available on select Exam Success CFA Program prep courses. It is a contract between you and Exam Success that obliges you to pay your total tuition fee (normally paid in a lump sum upon enrollment) in four equal and automatically-billed monthly installments plus a $25 per installment set-up fee.

The first of four installment payments is due at at checkout (official enrollment) and the remaining balance is to be paid over three automatically billed monthly installments scheduled over the duration of your course. Our courses are NOT drop-in or pay as you go. You understand Exam Success is advancing value to you in the form of educational services and that your right to enroll is expressly conditioned upon your agreement to pay these obligations on time in full, without an equivalent value of delivered of service.

In other words, if you choose to accept less services, you are still required to make your installment payments because the benefits have been available to you out of goodwill from the initial installment payment made. As long as you make all your scheduled payments as due, you can reduce or eliminate: interest services, reinstatement/new agreement fees, resources/class attendance prohibition, being reported to CFA Institute for candidate violation of CFA Institute Code of Ethics and Standards of Professional Conduct, and enforced collection actions. If you are in danger of defaulting on your payment agreement for any reason, contact us immediately. We generally do not take enforced collection actions or report misconduct to CFA Institute.

c. All prices are in Canadian dollars, unless otherwise noted, 13% HST will automatically be added.

d. NSF cheques and late payments are subject to a $40 admin fee. There may be a reinstatement fee if your installment Payment Plan agreement goes into default or is suspended. Penalties and interest continue to accrue until your balance is paid in full. A student who fails to make payment of tuition and fees, including any incidental fees, by the due date may be prohibited from registering/ attending classes /accessing resources, services and materials…until full payment is made. If you are in danger of defaulting on your payment agreement for any reason, contact us in writing. We reserve the right to report your liability with us to a credit agency/collections agency. We will generally not take enforced collection actions.

e. Payment confirmation receipt is automatically generated on-line every time you pay using our online payment system. If this is documentation is not sufficient for you or for income tax or corporate reimbursement purposes, request a receipt/copy of your registration form by contacting us and quoting Subject Line: "Tuition Receipt Request", provide any specific information/ curriculum details you require the receipt to include.

f. RESP Eligibility: Your Exam Success tuition may also be an eligible post-secondary educational institution RESP expense. Check with your financial institution for their specific proof of enrollment criteria. Exam Success provides documented proof (by email) to verify your Exam Success enrollment, if required. Make your request by email contacting us and quoting Subject Line: "RESP Enrollment Proof", provide all the specific information, as per your Financial Institution, your proof of enrollment document must contain.

Any requested Exam Success documentation, unless otherwise agreed upon, will be sent to you by email within TWO weeks provided that your final payment has been made and it is no earlier than THREE weeks after the program start date.

Note: Canada Revenue Agency is the official authority on all tax and RESP issues and should always be consulted if you are unsure about eligibility.

g. We reserve the right to correct any incorrect charges that might have occurred to orders.

2. CFA Program Prep Groups Savings (In-Person Only)

a. Unless otherwise noted a Group (3 or more candidates) who enroll in the same comprehensive CFA Program prep in-person course for the same exam season (same level) and pay in full with a credit card at time of enrollment get a 5% cash back tuition rebate.

b. In-Person CFA Program Prep Group Savings applies only when a) 1 returning Exam Success CFA student + 2 or more new students enroll together or b) 3 or more new students enrol together. A new student is someone who has never attended an Exam Success CFA Program or purchased Exam Success CFA material previously, in any year. Groups formed at an Exam Success hosted event are not eligible for the rebate. The 5% rebate is calculated based on the tuition price (pre-tax) in effect on the date of the student's' enrollment and will be issued 21 - 30 days after the program start date and only if all those in the group have remained in the program past the cancellation date. Group savings are not combinable with any other offers except the Early Bird. Only Groups who have submitted a Group Booking Request Form by email to Exam Success prior to enroling will eligible for the savings. Group enrollments are only offered on select courses, are subject to availability and, unless otherwise noted, must be made within 48 hours of the group's first enrollment.

3. CFA Program Prep Cancellations/ Withdrawals / Cancellations / Closures and Refunds

a. Online CFA Program Prep Courses/ Products:

i. FULL REFUND (< 24 hours): A full refund of your Exam Success online digital product fee is available within 24 hours of your purchase, as long there have been no logins. Exam Success does not refund set-up fees or fees charged for private tutoring.

Requesting a refund: Please contact us in writing and allow 5 business days for Exam Success to review your request. This gives Exam Success the necessary information to understand and process the request in a timely manner. Once the refund is issued, access to any related Exam Success support, content, or future updates will be revoked.

ii. NO REFUND (> 24 hours): After 24 hours your fees become non-refundable and non-transferable, regardless of utilization. This applies both to deposits and any other payments for all courses, private tutoring, workshops, product sales, and all other purchases, whether or not they were provided as part of a package or a promotion.

b. In-Person, Blended CFA Program Prep Courses:

This applies both to deposits and any other payments for all courses, classes, private tutoring, workshops, seminars and all other whether or not they were purchased as part of a package or a promotion.

i. PARTIAL REFUND 100 days or more: CFA Program Prep cancellations made at least 100 calendar days prior to the start date of the first class are eligible for a 100% refund of the tuition you paid, minus a $79 admin fee minus the regular retail price of any online product/ package included in the original program/package, regardless of utilization.

ii. PARTIAL REFUND 31-99 days: CFA Program Prep cancellations made 31- 99 calendar days prior to the start of the first class are eligible for a 100% refund of the tuition you paid, minus a $199 admin fee minus the regular retail price of any online product/ package included in the original program/package, regardless of utilization. Our programs are NOT drop-in or pay as you go. Enrollment tuition and fees are non-transferable.

iii. NO REFUND < 31 days: CFA Program prep cancellations made up to and including 30 calendar days prior to the start of the first class, regardless of the reason, are NOT eligible for any refund whatsoever, even in the event of a medical condition or other extreme circumstance. We reserve and pay for classroom space, equipment, furniture, support services, printing and admin fees on paid enrollments. All classrooms have limited seating and when a candidate wishes to cancel or withdraw after 31 days prior to program start date, his/her space in the course cannot be filled by another candidate. Our programs are NOT drop-in or pay as you go. Enrollment tuition and fees are non-transferable. Absence from class or failure to attend, for any reason, does not signify a cancellation/ withdrawal and does not reduce or relieve you of your financial responsibility and you remain liable for full tuition and fees charges.

NOTE: All notifications of CFA Program Prep cancellation must be received in writing by email. It may take up to 5 business days for an email/reply/confirmation so please plan accordingly. Contact us.

c. CFA Program Prep Cancellations/ Closures / Postponements/ Subsitutions:

i. CFA Program Prep classes that are cancelled or suspended due to school closures by reason of inclement weather, force majeure or any other cause that might endanger the health or safety of students, teachers and other staff, is a rare occurrence. However, if this does occur, fees remain constant and no refunds, partial payments or adjustments should be expected.

Depending on the specific conditions, Exam Success or designate may exercise discretion in modifying the teaching schedule and delivery means (may include use of online platforms).

ii. CFA Program Prep instructor absences or substitution: This is a rare occurrence but Exam Success reserves the right to have a supply instructor teach a lesson in the event a teacher is ill, absent or unavailable. In the event that an instructor is ill, absent, unavailable or there is a substitute instructor, fees remain constant. No refunds, partial payments, or adjustments should be expected.

iii. CFA Program Prep classes cancelled due to low enrollment: Every effort will be made to run classroom programs without changing dates and instructors. Programs that do not reach a minimum enrollment number by the scheduled program/class start date may be be cancelled and/or rescheduled to a later date at the sole discretion of Exam Success. Exam Success reserves the right to cancel and reschedule programs, classes, change fees, days, hours and instructors without prior notice. If Exam Success cancels or reschedules a program you are enrolled in due to low enrollment, you have the option of taking a full refund less the retail cost of any online product/package included in the package or transferring your program fee to another same exam-level Exam Success purchase for the same or following exam season. Exam Success’ liability is limited only to the reimbursement of the tuition fee, less applicable charges. Exam Success is not responsible for student's travel/accommodation or other expenses.

NOTE: CFA Program prep cancellations are only in effect once Exam Success has provided express confirmation by way of email.

4. CFA Program Exam Prep Course Upgrades, Downgrades, Deferrals, Discounts

a. CFA Program Prep Upgrades: Students can upgrade to a course (in the same exam season) that is more expensive or has the same price and is offered in the same exam season by just paying the applicable price difference between the two, provided that Exam Success has received the student's written request within 15 days of the original purchase and, if applicable, no more than 14 days from the start of the classroom delivered course to which the student would like to upgrade. Please note: Discounts are not available for upgrades, as you are only paying the difference in price between the two study packages. Also, purchasing an upgrade does not change your original expiration date. If you would like to upgrade, please contact us by email and we will send you an invoice so we can upgrade your account manually.

b. CFA Program Prep Downgrades (In-Person Only): Students can downgrade to a course that has a lower price and is offered in the same exam season if written request is received at least 31 days prior to the first class of the program from which the student wishes to transfer. The student will receive a refund of the difference less the regular retail price of any online product included in the original package (regardless of utilization) and will be required to pay a $79 processing fee for downgrades requested 100 days or more of the class start date and a $199 processing fee for downgrades requested between 99 and 31 days prior to the start of the first class.

c. CFA Program Prep Deferrals: Deferrals to the same Exam Success seminar/program/course... the next available exam season (not beyond) are considered on a case-by-case basis and only for extreme circumstances such as: (a) debilitating or life threatening and physician documented medical or psychological conditions (student or immediate family member), or (b) unanticipated and documented personal emergencies beyond the control of the candidate. This does not guarantee a deferral to any student for any condition instead provides Exam Success with the discretion to determine which deferral requests it approves and denies. For any request to be considered, an email deferral request accompanied by sufficient rationale and original supporting documentation must be received by Exam Success by email at least 10 days prior to the first scheduled class in the course from which the student would like to defer. Contact us in writing.

Students awarded a deferral are responsible for a non-refundable re-enrollment processing fee (due at the time of deferral) equivalent to 25% of the listed regular retail price for the same course/program the next available exam season. The minimum re-enrollment processing fee is $14975.

d. Discounts must be applied at time of enrollment and cannot be applied retroactively. Each discount cannot be combined with any other discount(s) or special offers from Exam Success. Discounts are not transferable and cannot be redeemed for cash.

NOTE: All notifications of Course Upgrades, Downgrades, Deferrals must be received in writing. Contact us. All upgrades and downgrades and deferrals are subject to availability.

5. Online Access Expiry

a. CFA Program Prep Products: Unlimited login access to online products / resources is available from the time after your purchase/ enrollment when your account is activated, until its expiry on exam day. Exam Success releases a new version of products every year as curricula change. Shared use is strictly prohibited. Use of Online Access via www.examsuccess.ca. Exam Success does not warrant that this Online Access will be uninterrupted or error-free. Online Access to www.examsuccess.ca is provided on an "as is, as available" basis.

6. Success Guarantee: CFA Program Prep Course Retakes

Our aim is for our students to pass and we stand behind our study solutions! In the event you do not pass or write the exam for which you were scheduled, or whatever the reason, we have these repeat privileges available on select course purchases:
i. FREE RETAKE of the Complete Sudy Package, our most comprehensive program. Receive a FREE retake with updates, for a new exam date that falls within 1 year of the exam date that corresponded with your orginal purchase. Free re-enrollment is subject to availability at the time of re-enrollment.
NOTE: You must contact Exam Success in writing and provide a copy of your official CFA exam registration document with your re-enrollment request.
i. DISCOUNTED RETAKE of our most comprehensive course. Receive a discounted retake, for a new exam date that falls within 1 year of the exam date that corresponded with your original purchase. Discount is up to 50% off the regular (pre-discounted) price in effect at the time of re-enrollment. Discounted re-enrollment is subject to availability and fees are due at the time of re-enrollment. Re-enrollment admin fee and deposits are not refundable.
Note:You must contact Exam Success in writing and provide a copy of your official CFA exam registration document with your re-enrollment request.
i.To be eligible for The Success Guarantee, you must be or have been enrolled in Exam Success eligible CFA course, for which you have paid in full. For clarity, you are not eligible for the Success Guarantee if your enrollment in an Exam Success eligible CFA course if it was paid for in whole or in part by an organization or government entity, including but not limited to schools, school districts, colleges, universities, student organizations, non-profit entities, and businesses or, unless explicitly stated otherwise, if the course or its contents were made available for free. Exam Success may at its sole discretion void your Success Guarantee privileges if it reasonably believes that you have violated the Terms.
ii. While we do everything in our power to make the exam-prep process painless, passing the CFA exam is ultimately your responsibility and Exam Success makes no guarantee, warranty or representation whatsoever regarding relating to the passing of the actual exams.

7. Privacy

a. If you choose to open an account with us, request support, subscribe or in any other way take steps that require the submission of Personal Information or Non-Personal Information, we may collect information such as your name, email address, phone number, and/or physical address to be used by us or our affiliates or by companies pre-screened by us to provide you with the services or functionality you have requested; respond to any inquiries you have made; contact you to promote our Services or alert you to special offers or features. We do not sell or rent your personal information to any company, organization or individual. We will retain your information throughout and beyond the exam season to help us to communicate with you and to contact you when we feel that we have new information or programs that may be of interest to you. You may opt out of receiving such materials at any time by contacting us, provided however that we reserve the right to retain an archive of such Personal Information for a commercially reasonable time to ensure that its deletion does not affect the integrity of our data; and we further reserve the right to retain an anonymous version of such information.

8. Intellectual Property /Right to Transfer/Single User License

a. Your subscription to any Online Access, including PDFs is a limited license to use the content only between the time of access is granted and the exam date of the product purchase. You may not enroll in or use any Program for the benefit of any competitor of Exam Success.The subscription is licensed for the personal, non-commercial use and benefit of the registered customer only, and grants user rights to only one individual. No other individual or group may view or utilize the subscription in anyway whatsoever without the express written consent of Exam Success. Usernames/user ids and passwords are not to be shared with anyone, even if that person has his or her own subscription to Online Access. Such sharing or suspected sharing of usernames/user ids and passwords is a violation of the Terms and will result in immediate suspension of your privileges to any Online Access at info@examsuccess.ca without refund or credit.

Exam Success monitors its website, including the use of Online Access, for visitors and enforces its one subscriber-one user policy diligently. Creating, purchasing, and/or using photocopied (i.e., pirated, illicit copies) Exam Success study notes and other preparatory materials violates the law and may violate Code of Ethics and Standards of Professional Conduct as set forth by the respective accrediting agencies.

9.Recording/ Duplicating

a. You may not copy or reproduce, distribute, share through any information network, transfer, sell, lease or rent any part of the course or materials to any other person or group, in whole or in part.

10. Consent release for use of images for promotional purposes

a. Exam Success reserves the right to take and use student photographs/video material, testimonials and personal information for Exam Success promotional purposes (both hard copy and electronic) such as website, brochures, displays, website, social media and advertisements.

11. Liability Release Waiver

a. Exam Success provides services that allow users to connect with tutors and instructors who provide live, one-to-one tutoring and learning services and classroom instruction in person or online. We generally do not control, and we make no representations or warranties regarding the reliability of, any verification service or any information provided by such verification service we use to confirm the validity of our tutors’ lack of criminal history and claimed educational credentials.

b. You agree to release, indemnify and hold harmless Exam Success and its employees and contractors, from and against all claims of injury, damage or loss of any kind whatsoever arising out of the participation in any activities associated with Exam Success.

12. Student Code of Conduct

Exam Success reserves the right to remove any student from any course for: (1) serious and/or repeated disruptions to the learning environment (i.e. use of profanity, cell phone use during class time etc.); (2) deliberate destruction, misuse, or theft of property of Exam Success or its students, facilities, staff and visitors; (3) abusive, harassing, threatening or violent conduct, as determined by Exam Success; (4) failure to comply with federal copyright and criminal laws forbidding the misappropriation, copying, or alteration of copyright-protected materials; (4) failure to comply with Exam Success' or it's teaching facilities' health and safety policies, and (5) other serious misconduct that in Exam Success' estimation warrants a student’s removal from a program. Students removed from Programs for violations of the Code of Conduct are not eligible for refunds or eligible to purchase other Programs.

b. Failure to abide by these Terms will result in immediate termination of your course and/or access to materials and services without refund or option to transfer/reschedule.

13. Your Acceptance of These Terms

a. Exam Success may modify the Terms at any time and such modifications shall be effective immediately upon posting of the modified Terms of Use and are subject to change without notice. You agree to review the Terms periodically to be aware of such modifications and your continued access or use of Online Access and other preparatory materials and services shall be deemed your conclusive acceptance of the modified agreement. If you object to these Terms or any subsequent modifications to these Terms or become dissatisfied with Our Website in any way, your only recourse is to immediately terminate use of Our Website.

b. Failure to abide by these Terms will result in immediate termination of your course and/or access to materials and services without refund or option to transfer/reschedule.
